Welcome to Annie, a conversational AI tool designed to assist with research, content creation, presentations, operations, scheduling, messaging, and general productivity. Annie is not a human, and all responses are generated using AI models based on patterns and probability. By accessing, using, or communicating with Annie, you acknowledge that you have read, understood, and agree to these Terms of Use and Privacy Policy.

If you do not agree with any part of these terms, you must stop using Annie immediately.

2. Intended Use

Annie may assist with:

• Writing, research, summarization
• Presentation creation, SMS/email drafting
• Task instructions and workflow support
• Business assistance, education, and general inquiry

Annie may be incorrect or produce inaccurate information. AI outputs should be reviewed, validated, and used at your own discretion.

Annie is not a replacement for legal, medical, tax, or licensed professional advice.

3. User Responsibilities

By using Annie, the user agrees:

1. You are solely responsible for reviewing, validating, and verifying all outputs.
2. Annie may generate incorrect, speculative, or outdated information.
3. You are fully responsible for how generated content is used, shared, or acted upon.
4. You will not request or engage in harmful, abusive, or illegal behavior through the platform.

We are not liable for decisions you make based on AI-generated responses.

4. Speech & Conduct Policy

The user agrees NOT to request, generate, share, or submit content involving:

• Profanity, obscenity, or explicit sexual content
• Hate speech, harassment, bullying, or threats
• Racial, ethnic, gender-based, or religious slurs
• Illegal activities or instructions to commit harm
• Discriminatory, defamatory, or exploitative material
• Adult content, exploitation, or sexualized imagery

Violation may result in immediate termination of access to Annie.

5. Multi-Model AI Output Source Disclosure

Annie generates responses using multiple AI systems and may route content through:

• ChatGPT (OpenAI)
• Google Gemini 2.0 & 3.0
• Perplexity AI
• Internal curated datasets from Peter C. Fuller

Because processing may occur through external models, Annie cannot guarantee confidentiality of submitted content. Do not input private, regulated, or legally sensitive information.

5a. Google API Services Usage

Annie integrates with Google API Services to provide email functionality. Our use of Google API data complies with the Google API Services User Data Policy, including the Limited Use requirements.

Specifically:

• Google user data is used only to provide and improve the email features you explicitly authorize
• Google user data is not used for advertising, market research, or profiling
• Google user data is not sold, leased, or transferred to third parties except as necessary to provide the service or as required by law
• Google user data is not used to train AI or machine learning models

6. Intellectual Property & Use License

Curated content ownership

Some responses may be generated from original curated frameworks, documents, instructions, prompts, training material, automation logic, or content owned by Peter C. Fuller.

All curated content in any form is:

Users may not:

• Remove or alter copyright notices

7. Commercial Use Policy

You may use AI-generated output commercially, unless it contains proprietary frameworks, methodologies, or protected content originating from Peter C. Fuller.

If content includes curated or proprietary frameworks, attribution is required. Where uncertainty exists, the user must request written approval.

8. Limitation of Liability

Annie is provided as-is, with no guarantees of accuracy, reliability, or fitness for any purpose. By using the system, you agree that:

• We are not liable for errors, damages, losses, or inaccuracies
• We are not responsible for actions taken based on AI suggestions
• Use is at your own risk — validate information independently

9. Termination of Service

We reserve the right to suspend, revoke, or terminate access to Annie for any reason, including violation of use or speech policies.

10. Governing Law & Arbitration

These terms are governed by the laws of the State of California.

Any dispute will be resolved by binding arbitration in California, rather than court litigation. Users agree to waive class action rights.

11. Information We Collect

Annie collects the following data:

• Email address (via Stripe checkout)
• Phone number (via onboarding-success page)
• Stripe customer ID, card brand + last four digits

B. Through Communication Channels

C. Usage & Interaction History

• Token balance + spending history
• Conversation logs and commands
• Action history: SMS sends, presentation builds, research tasks

D. Technical Metadata

• IP address + browser user-agent
• Timezone preference
• Beta acceptance + interaction timestamps

Data Storage

All data is stored in Supabase with Row-Level Security (RLS). Users may only access their own records unless designated as admins.

12. How We Use This Data

Data is used to:

• Deliver AI functions and personalize performance
• Track token usage, billing, and subscription status
• Improve model accuracy and user experience
• Prevent fraud, abuse, and misconduct
• Identify preferred communication channels

We do not sell personal data.

13. Third-Party Processing

User content may be processed by external LLMs (ChatGPT, Gemini, Perplexity). These systems may temporarily retain or analyze input to generate output.

If you do not consent to third-party model processing, do not use Annie.

14. CCPA California Privacy Rights

California users have the right to:

• Request access to personal data collected
• Request correction or deletion
• Opt-out of third-party data sharing
• Request disclosure of how data is used

15. Data Retention + Deletion

16. ElevenLabs AI Agent Consent

We use ElevenLabs Agents to help power our AI-powered voice assistant experiences. By clicking "Agree" and each time you interact with this AI agent, you consent to us, ElevenLabs, and each of our service providers (including third-party LLM providers) recording, viewing, storing, and sharing your communications to provide the service, improve our products and services, train machine learning models, and comply with applicable law.

1. Eligibility and Account Security

You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. You agree to provide accurate account information and keep it current.

You are responsible for safeguarding your login credentials, devices, and verification methods and for activity conducted through your account. Notify us promptly at operations@petercfuller.com if you believe your account has been accessed without authorization.

2. Informational Service; No Financial Advice

BudgetBeater AI provides budgeting, categorization, forecasting, alerting, and informational tools. The Service does not provide financial, investment, tax, legal, accounting, credit, or other professional advice and is not a financial institution, broker, investment adviser, lender, or credit counselor.

You are solely responsible for your financial decisions. Consider consulting a qualified professional before acting on information provided by the Service.

3. Accuracy and User Responsibility

Financial data, account balances, transaction details, categories, forecasts, alerts, and AI-generated responses may be delayed, incomplete, duplicated, or inaccurate. You agree to:

• Verify important information directly with the applicable financial institution or source before relying on it
• Review transaction categories, budgets, forecasts, and recommendations for accuracy
• Maintain sufficient funds and independently monitor bills, payment dates, balances, and account activity
• Remain responsible for all decisions and actions taken based on the Service

The Service is not a substitute for official account statements or records.

4. Plaid-Linked Financial Accounts

BudgetBeater AI uses Plaid Inc. ("Plaid") to enable you to connect eligible financial accounts. When you choose to connect an account, you authorize BudgetBeater AI and Plaid to access, retrieve, process, and transmit information from the financial institutions you select, which may include account names and types, balances, transaction history, merchant information, and account identifiers.

Your use of Plaid is subject to the Plaid End User Services Agreement and the Plaid End User Privacy Policy. Plaid is an independent service provider, and its services may be subject to separate terms imposed by Plaid or your financial institution.

BudgetBeater AI does not receive or store your online-banking username or password. Financial account information is made available through Plaid after you authorize the connection.

You may disconnect a linked financial account through the Service when that option is available or by contacting us. Disconnecting stops the retrieval of new information but does not automatically delete information previously received. Deletion requests are handled under our Privacy Policy.

5. No Transaction Authority

Unless a separate feature clearly states otherwise and you provide specific authorization, BudgetBeater AI is a read-only budgeting and information service. It does not initiate bank transfers, payments, trades, withdrawals, deposits, or other transactions, and it cannot stop or reverse transactions made through your financial institution.

6. Third-Party Services and Integrations

The Service may interoperate with third-party products such as Plaid, financial institutions, Google Sheets, Zapier, Twilio, and AI model providers. Your use of those products may be governed by their own terms and privacy policies.

We do not control and are not responsible for third-party services, their availability, their accuracy, or changes they make. A third-party connection may be unavailable, delayed, suspended, or discontinued at any time.

7. Alerts, Messages, and Electronic Communications

If you enable text or other notifications, you consent to receive account, budget, forecast, security, and service messages at the contact information you provide. Message and data rates may apply. Delivery is not guaranteed and alerts may be delayed.

You may change notification preferences or opt out of nonessential text messages by following the instructions in a message. Security, legal, and essential account notices may still be delivered electronically where permitted by law.

8. Artificial Intelligence Features

AI-generated categories, insights, forecasts, answers, and recommendations are probabilistic and may be incorrect or unsuitable for your circumstances. You must independently review AI output before relying on it. Do not use AI output as the sole basis for significant financial decisions.

9. Acceptable Use

You may not:

• Use the Service for unlawful, fraudulent, deceptive, abusive, or unauthorized purposes
• Access or attempt to access another person's account or financial information
• Interfere with the security, operation, or integrity of the Service
• Upload malicious code or use automated means to scrape, copy, overload, or probe the Service
• Reverse engineer, resell, sublicense, or commercially exploit the Service except as expressly permitted in writing
• Misrepresent your identity, authority, or ownership of a connected financial account

10. Ownership and License

The Service, including its software, designs, content, models, workflows, trademarks, and related intellectual property, is owned by Peter C Fuller, Inc. or its licensors and is protected by applicable law.

Subject to these Terms, we grant you a limited, personal, revocable, nonexclusive, nontransferable license to use the Service for your own lawful purposes. You retain ownership of information you submit and grant us permission to process it only as needed to operate, secure, and improve the Service as described in our Privacy Policy.

11. Fees, Renewals, and Cancellation

If paid plans are offered, applicable prices, billing intervals, renewal terms, trial conditions, and cancellation instructions will be disclosed before purchase. You authorize the disclosed charges and are responsible for applicable taxes. Except where required by law or stated at purchase, fees are nonrefundable.

12. Service Availability and Changes

We may modify, suspend, or discontinue all or part of the Service, including connected-account or AI features. We do not guarantee uninterrupted, secure, or error-free operation, continuous access to third-party data, or compatibility with every financial institution or device.

13. Suspension and Termination

We may suspend or terminate access if you violate these Terms, create risk or liability, misuse the Service, fail to pay applicable fees, or if required by law or a third-party provider. You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." PETER C FULLER, INC. DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT FINANCIAL DATA, FORECASTS, ALERTS, OR AI OUTPUT WILL BE COMPLETE, CURRENT, OR ERROR-FREE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETER C FULLER, INC. AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, OR OPPORTUNITIES; FINANCIAL LOSSES OR OVERDRAFTS; OR DAMAGES ARISING FROM RELIANCE ON DATA, ALERTS, FORECASTS, OR AI OUTPUT. OUR TOTAL LIABILITY ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE CLAIM OR $100, EXCEPT WHERE LAW DOES NOT PERMIT THIS LIMITATION.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Peter C Fuller, Inc. and its officers, employees, contractors, and service providers from claims, losses, liabilities, and expenses arising from your misuse of the Service, violation of these Terms, infringement of another party's rights, or unauthorized connection or use of a financial account.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. To the extent permitted by law, disputes will be resolved by binding individual arbitration in California rather than in court, and you waive participation in class or representative proceedings.

18. Changes to These Terms

We may update these Terms from time to time. We will post revised Terms on this page and update the date shown above. If a change materially affects your rights, we will provide additional notice when required by law. Continued use after the effective date of revised Terms constitutes acceptance.
